1. Acceptance of Terms

By accessing or using Quiz for Brains, you agree to these Terms of Service. These terms form a legally binding agreement between you and Quiz for Brains Limited.

If you do not agree to these terms, you must not use the Service.

2. About the Service

Quiz for Brains is a hosted quiz platform that lets customers generate, review, present, and manage quiz events.

• Quiz generation and preview workflows
• Host controls, team management, and scoring
• Display screens and player participation features
• Support for text, image, audio, and video quiz media

3. Accounts and Eligibility

• You must provide accurate account information and keep it up to date.
• You are responsible for safeguarding your login credentials and all activity under your account.
• You must verify your email address before logging in to a standard customer account.
• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase paid services.

4. Plans, Billing, and Access Periods

Available paid offerings include:

• Weekly Quiz Subscription: Available on weekly, monthly, or annual billing cycles.
• Monthly Quiz Subscription: Available on monthly or annual billing cycles.
• Single Quiz Purchase: A one-time, non-recurring purchase.

Billing terms:

• Recurring subscription fees are charged in advance at the start of each billing period.
• Recurring subscriptions renew automatically unless cancelled before the next renewal.
• Billing and payment processing are handled by Stripe.
• Except where required by applicable law, all payments are final and non-refundable.
• We may change pricing for future billing periods. Where reasonably practicable, we will give advance notice before a pricing change takes effect for an existing recurring subscription.

Quiz access periods:

• Weekly quiz access: The current quiz is intended to run on a 7-day cycle.
• Monthly quiz access: The current quiz is intended to run on a monthly cycle.
• Single Quiz Purchase: Access lasts for 30 days from purchase or activation.
• When a recurring quiz period ends, the Service may generate a replacement preview quiz for customer review before it is accepted for use.

5. Intellectual Property and Licence

The Service, including quiz packs, question sets, answers, compiled media packages, software, design, branding, and associated platform data supplied through it, is owned by Quiz for Brains Limited or its licensors and is protected by intellectual property laws.

• Your purchase or subscription gives you a limited, non-exclusive, non-transferable, revocable licence to use the Service and the quiz materials we supply for your own internal business, venue, educational, or event use.
• You do not acquire ownership of quiz materials, supplied question banks, or platform data by using the Service.
• You must not resell, redistribute, sublicense, publish, scrape, reproduce at scale, or create a competing service from materials supplied through the Service without written permission.
• If you upload material to the Service, you confirm you have the right to provide and use that material.

6. Acceptable Use

• You must not use the Service unlawfully or in a way that infringes another person's rights.
• You must not attempt unauthorized access, interfere with platform operation, or bypass security controls.
• You must not use automated means to extract or harvest quiz content without permission.
• We may suspend or restrict access if we reasonably believe your use breaches these terms or presents security, legal, or operational risk.

7. Availability and Support

We work to keep the Service available and reliable, but we do not guarantee uninterrupted, error-free, or always-available operation.

• The Service depends on third-party providers, including hosting, database, email, and payment providers.
• Maintenance, updates, incidents, and third-party outages may affect availability.
• Support is available by email at support@quizforbrains.com.
• We aim to respond within a reasonable time, but we do not guarantee any specific response or resolution timeframe.
• We may prioritize support based on issue severity, account status, or plan type.

8. Cancellation, Suspension, and Deletion

Customer cancellation:

• Recurring subscriptions may be cancelled through the Stripe billing portal.
• Cancellation stops future renewals, and access continues until the end of the current paid billing period unless we suspend the account under these terms.
• Single Quiz Purchases do not recur and do not require cancellation.

Account deletion:

• If you request self-service account deletion, your account is marked for deletion and scheduled for permanent deletion 90 days later.
• We may log you out, disable access, or otherwise restrict account use after a deletion request is submitted.
• Permanent deletion is intended to occur after the 90-day scheduled period, subject to operational and legal requirements.

Suspension or termination by us:

• We may suspend or terminate access for non-payment, misuse, fraud, security concerns, legal compliance, or breach of these terms.
• Where appropriate, we may give notice before suspension or termination, but we are not required to do so in every case.

9. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy. Key points include the following:

• All data is encrypted in transit using HTTPS/TLS.
• Passwords are hashed using bcrypt before storage.
• Customer data is stored using our hosted infrastructure and supporting service providers.
• We use third-party providers for services including email delivery and payment processing.

10. Limitation of Liability

To the maximum extent permitted by law, Quiz for Brains Limited is not liable for indirect, incidental, consequential, special, exemplary, or punitive loss arising from your use of the Service.

To the maximum extent permitted by law, our aggregate liability for claims relating to the Service will not exceed the amounts paid by you for the Service in the 12 months before the event giving rise to the claim.

11. Changes to the Service or Terms

We may update the Service, these terms, or our pricing from time to time. If we make a material change to these terms, we may notify you by posting an updated version, by email, or through the Service. Your continued use of the Service after the updated terms take effect constitutes acceptance of the revised terms.

12. Governing Law and Disputes

These terms are governed by the laws of New Zealand.

Subject to any mandatory rights you may have under applicable law, disputes relating to these terms or the Service will be dealt with by the courts of New Zealand.
