1. Acceptance of Terms

By accessing and using Quiz for Brains ("the Service", "our platform", or "we"), you accept and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Quiz for Brains.

If you do not agree to these terms, you must not access or use the Service. Your continued use of the Service constitutes acceptance of any updates to these terms.

2. Service Description

Quiz for Brains is a web-based platform (www.quizforbrains.com) that provides:

• Live Presentation: Quiz Display Screen for big screens with real-time quiz progression
• Host Controls: Quiz Remote Control for managing teams, scoring, and quiz flow
• Virtual Participation: Remote player functionality with join codes
• Team Management: Save teams, track scores, and maintain quiz history
• Media Support: Questions and answers with images, videos, and audio

The Service is designed for venues, organisations, educational institutions, and individuals running quiz events, trivia events, or training sessions.

3. User Accounts and Registration

To use the Service, you must create an account by providing:

• A unique customer ID
• A valid email address
• A secure password (encrypted using industry-standard bcrypt)
• Your business or organization name

Account Security and Responsibilities:

• You are solely responsible for maintaining the confidentiality of your password
• You must verify your email address before accessing premium features
• You must notify us immediately at support@quizforbrains.com of any unauthorized access
• You may not share your account credentials or allow others to use your account
• You may not create multiple accounts for the same entity
• We reserve the right to suspend or terminate accounts that violate these terms

4. Subscription Plans and Billing

Available Plans:

• Weekly Quiz (Weekly Billing): Billed every 7 days, new quiz event every week, auto-renews
• Weekly Quiz (Monthly Billing): Billed monthly, new quiz event every week
• Weekly Quiz (Annual Billing): Billed annually, 52 quiz events per year
• Monthly Quiz (Monthly Billing): Billed monthly, new quiz event every month
• Monthly Quiz (Annual Billing): Billed annually, 12 quiz events per year
• Single Quiz Purchase: One-off quiz event purchase, no recurring charges

Billing Terms:

• Subscription fees are billed in advance at the start of each billing cycle
• Payment processing is handled securely via Stripe. Auto-renewal is enabled by default and can be cancelled at any time through the Stripe Billing Portal in your profile
• All fees are in New Zealand Dollars (NZD) unless otherwise stated
• We reserve the right to change pricing with 30 days' notice to active subscribers
• Failure to pay may result in quiz generation suspension or account termination

Quiz Access Periods:

• Weekly plans: Each quiz is valid for 7 days from the date it was generated. A new quiz is made available automatically when the current one expires.
• Monthly plans: Each quiz is valid for one calendar month from the date it was generated. A new quiz is made available automatically when the current one expires.
• One-Time Quiz: Single quiz purchases do not expire and are not subject to automatic replacement.
• When a quiz expires, a new quiz is automatically prepared for your review. You must accept the new quiz before it goes live — nothing is presented to your players without your approval.
• Quiz access periods run on a rolling schedule from the previous quiz's expiry date, not from the date you log in, so your quiz event schedule stays consistent.

5. Content and Intellectual Property

Your Content:

• You retain all ownership rights to quiz questions, answers, media files, and team data you create
• You grant us a non-exclusive, worldwide license to host, store, process, and display your content solely to provide the Service
• This license terminates when you delete your content or account (subject to backup retention policies)
• You represent and warrant that you own or have rights to all content you upload
• You are solely responsible for ensuring your content does not infringe copyright, trademark, or other intellectual property rights
• We may remove content that violates these terms or applicable laws

Our Intellectual Property:

• The Quiz for Brains platform, software, design, features, and documentation are our exclusive property
• Our trademarks, logos, and branding materials may not be used without written permission
• You may not reverse engineer, decompile, or attempt to extract source code from our platform
• You may not copy, modify, distribute, or create derivative works from our platform

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations
• Upload content that is offensive, defamatory, or infringes on others' rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers connected to the service
• Use automated systems to access the service without permission

7. Service Availability and Support

Uptime and Availability:

• We target 99.9% uptime but do not guarantee uninterrupted access
• The Service is hosted on Vercel's infrastructure with global distribution
• Scheduled maintenance will be announced in advance when possible
• Emergency maintenance may occur without notice
• We are not liable for downtime caused by third-party services (Vercel, Upstash Redis, Resend)

Technical Support:

• Email support available at support@quizforbrains.com
• Support requests are typically responded to within 48 hours (business days)
• Priority support may be available for annual subscription customers

8. Limitation of Liability

Quiz for Brains shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service. Our total liability shall not exceed the amount paid by you for the service in the twelve months preceding the claim.

9. Account Termination and Data Deletion

Termination by You:

• You may cancel your subscription at any time through the Stripe Billing Portal, accessible from your profile page
• Cancellation takes effect at the end of your current billing period
• You may request account deletion by contacting support@quizforbrains.com
• Account deletion is permanent and cannot be undone

Termination by Us:

• We may suspend or terminate accounts that violate these terms
• We may terminate accounts for non-payment after reasonable notice
• We will provide notice before termination unless legally prohibited

Data Handling Upon Termination:

• Your quiz content, team data, and history remain accessible for 30 days after cancellation
• After 30 days, your data will be permanently deleted from our systems (Upstash Redis database)
• Backup copies may persist for up to 90 days for disaster recovery purposes
• No refunds for unused subscription time, except at our sole discretion upon request to support@quizforbrains.com
• Accounts terminated for terms violations forfeit all data access and refund rights

10. Cancellation Policy

Cancellation Terms:

• Subscriptions can be cancelled at any time through the Stripe Billing Portal, accessible from your profile page
• Cancellation is effective at the end of the current billing period — you retain full access to the Service until then
• Auto-renewal is disabled upon cancellation; no further charges will be made
• Single Quiz purchases are non-recurring and do not require cancellation

Refunds:

• All sales are final. We do not offer refunds for subscription fees or one-time purchases
• In exceptional circumstances, we may consider refund requests at our sole discretion. Contact support@quizforbrains.com to discuss your situation
• Accounts terminated for terms violations or fraudulent activity forfeit all access and any refund eligibility

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our platform. Continued use of the service after changes constitutes acceptance of the new terms.

12. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy. Key points:

• All data is encrypted in transit using HTTPS/TLS
• Passwords are hashed using bcrypt before storage
• Customer data is stored securely in Upstash Redis database
• We use Resend for transactional emails (verification, password resets)
• Session tokens are securely generated and validated
• We do not sell or share your personal information with third parties

13. Governing Law and Disputes

These terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles.

Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand. You agree to submit to the personal jurisdiction of such courts.
